1. Agreement to Terms

By accessing or using Fusillade ("Service"), operated by Fusillade ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

2. Description of Service

Fusillade is a load testing platform that allows users to simulate traffic to web applications, APIs, and other network services. The Service includes:

  • A command-line interface (CLI) for local and cloud-based load testing
  • Cloud infrastructure for distributed load generation
  • A web dashboard for test management, monitoring, and analytics
  • APIs for programmatic access and CI/CD integration

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent or malicious purposes.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must NOT use Fusillade to:

  • Attack systems you do not own or have explicit authorization to test. You must have written permission from the system owner before conducting any load tests.
  • Conduct Distributed Denial of Service (DDoS) attacks or any form of malicious traffic generation
  • Test or attack critical infrastructure, government systems, healthcare systems, or financial institutions without proper authorization
  • Violate any applicable local, national, or international law or regulation
  • Infringe upon the rights of others, including intellectual property rights
  • Transmit malware, viruses, or other malicious code
  • Attempt to gain unauthorized access to other systems or networks
  • Interfere with or disrupt the Service or servers connected to the Service
  • Resell, sublicense, or redistribute the Service without our written consent
  • Use the Service to send spam or unsolicited communications
  • Circumvent usage limits, quotas, or other restrictions

WARNING: Unauthorized load testing may constitute a criminal offense in many jurisdictions. You are solely responsible for ensuring you have proper authorization before testing any system. We cooperate with law enforcement and will report illegal activity.

5. Authorization Requirements

Before conducting any load test, you must:

  • Own the target system, OR
  • Have explicit written authorization from the system owner
  • Ensure your testing complies with the target system's terms of service
  • Notify relevant parties (hosting providers, CDNs) if required by their policies

We may request proof of authorization at any time. Failure to provide such proof may result in immediate account suspension.

6. Service Tiers and Payment

The Service is offered in multiple tiers with different features and usage limits. Free tier users are subject to the limitations described on our Pricing page.

For paid subscriptions:

  • Fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days' notice
  • Overage charges are billed at the rates specified on our Pricing page
  • Failure to pay may result in service suspension or termination

7. Intellectual Property

The Fusillade CLI is open source software licensed under the AGPL v3 license. The cloud Service, including our infrastructure, web dashboard, and APIs, remains our proprietary property.

You retain ownership of all test scripts, configurations, and data you create or upload. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to our data practices as described in the Privacy Policy.

Test results and metrics are retained according to your subscription tier. You may export or delete your data at any time through the dashboard or API.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend access for maintenance, updates, or emergency repairs.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for significant changes when possible.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, secure, or available at all times. Test results are provided for informational purposes and should be validated independently for critical decisions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Fusillade and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any unauthorized load testing conducted through your account

13. Termination

You may terminate your account at any time by contacting us or using the account deletion feature in the dashboard.

We may terminate or suspend your account immediately, without prior notice, if:

  • You breach these Terms
  • We are required to do so by law
  • We reasonably believe your account is being used for illegal activity
  • You fail to pay applicable fees

Upon termination, your right to use the Service ceases immediately. Data retention after termination is subject to our Privacy Policy.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Finland, and you consent to the personal jurisdiction of such courts.
